TERMS OF USE & ONLINE COACHING AGREEMENT

These Terms of Use & Online Coaching Agreement (“Agreement”) govern your access to and use of services provided by Riders Ready Proformance (“Company,” “we,” “us,” or “our”), including in-person training, online coaching delivered through My PT Hub, website content, programs, and related services.

By purchasing, enrolling in, or participating in any services, you agree to be bound by this Agreement.

1. Eligibility

By using our services, you represent and warrant that:

  • You are at least 18 years old, or have written parental/guardian consent.

  • You are medically and physically able to participate in exercise.

  • You have consulted a physician prior to beginning any training program.

  • All information you provide is accurate and complete.

2. Health & Medical Disclaimer

Riders Ready Proformance provides fitness coaching services only and does not provide medical advice, diagnosis, or treatment.

You acknowledge that:

  • Physical exercise involves inherent risks, including serious injury or death.

  • You are voluntarily participating in physical activity.

  • You are solely responsible for monitoring your health and physical condition.

  • You will stop exercising immediately if you experience pain, dizziness, shortness of breath, or discomfort.

Nutrition guidance provided is for general educational purposes and is not medical nutrition therapy.

3. Assumption of Risk & Release of Liability

To the fullest extent permitted by law, you agree:

  • You voluntarily assume all risks associated with participation in training.

  • You release and hold harmless Riders Ready Proformance, its owners, coaches, employees, contractors, and affiliates from any and all claims, liabilities, damages, or injuries arising from participation.

  • You accept full responsibility for any injury, loss, or damage incurred during participation in services.

Online Coaching Specific Risk Acknowledgment

Online coaching is inherently limited by the absence of in-person supervision. You acknowledge that improper execution of exercises may result in injury and accept full responsibility for ensuring safe performance of all movements.

You understand that:

  • You are exercising without direct physical supervision.

  • You are responsible for using proper form.

  • You are responsible for ensuring your environment and equipment are safe.

4. Services Provided

Services may include:

  • Personalized strength and conditioning programs

  • Online coaching delivered via My PT Hub

  • Program updates and feedback

  • Video movement analysis

  • Nutrition guidance (non-medical)

  • In-person training (if applicable)

  • Educational materials and digital resources

We reserve the right to modify or discontinue services at any time.

5. Online Coaching & My PT Hub Platform

Online coaching is delivered primarily through the My PT Hub platform (“Platform”).

By enrolling in online coaching:

  • You agree to create and maintain an active Platform account.

  • You are responsible for maintaining login confidentiality.

  • You agree not to share your account with others.

  • You understand My PT Hub operates as a third-party service provider with its own Terms and Privacy Policy.

Riders Ready Proformance is not responsible for:

  • Platform outages

  • Technical malfunctions

  • Third-party data breaches

  • Service interruptions outside our control

6. Client Responsibilities

You agree to:

  • Accurately report workouts and health status.

  • Disclose injuries, pain, or medical conditions.

  • Follow programming responsibly.

  • Seek medical clearance if needed.

  • Maintain a safe workout environment.

Failure to disclose relevant health information increases your risk and remains your responsibility.

7. Communication Policy

  • Coaching communication occurs primarily through My PT Hub.

  • Standard response time is within 24–48 business hours.

  • Coaching does not include 24/7 availability.

  • Missed check-ins may delay programming updates.

8. Payments & Billing

Payment Terms

  • Payment is required in advance unless otherwise agreed in writing.

  • Recurring online coaching subscriptions renew automatically.

  • Prices are subject to change with notice.

Refund Policy

  • All sales are final unless otherwise stated in writing.

  • No refunds for partial months or unused sessions.

  • Missed sessions are non-refundable.

Cancellation

  • Written notice is required at least 7 days prior to billing renewal.

  • Cancellations after billing are not eligible for partial refund.

9. Intellectual Property

All materials provided by Riders Ready Proformance, including:

  • Training programs

  • Workout plans

  • Videos

  • PDFs

  • Branding

  • Logos

  • Written content

are the exclusive intellectual property of Riders Ready Proformance.

You may not reproduce, distribute, sell, or share materials without written permission.

10. Results Disclaimer

Individual results vary. We make no guarantees regarding:

  • Fat loss

  • Muscle gain

  • Performance improvements

  • Health outcomes

Results depend on effort, consistency, lifestyle factors, and individual biology.

Testimonials do not guarantee similar outcomes.

11. Termination of Services

We reserve the right to suspend or terminate services if:

  • You violate this Agreement.

  • You engage in unsafe conduct.

  • You fail to make payments.

  • You behave abusively toward staff.

Termination does not entitle you to a refund.

12. Privacy

Your personal data is handled in accordance with our Privacy Policy. By using our services, you consent to data collection necessary to provide coaching services.

13. Governing Law

This Agreement shall be governed by the laws of the State of Minnesota, without regard to conflict of law principles.

14. Dispute Resolution

Any dispute arising under this Agreement shall be resolved through:

  1. Good faith negotiation

  2. Mediation, if necessary

  3. Binding arbitration in the State of Minnesota

You waive the right to participate in class action litigation.

15. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force and effect.

16. Agreement Acceptance

By purchasing or participating in services, you acknowledge that:

  • You have read this Agreement.

  • You understand its contents.

  • You agree to be legally bound by its terms.
